Counter-Notification Process
If your content was removed due to a copyright infringement claim, you may submit a counter-notification. This process allows you to dispute the removal of your material. The counter-notification must meet specific legal requirements.
Required Elements for a Valid Counter-Notification:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled. Include the location where the material appeared before its removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the U.S., for any judicial district in which The Straus House may be found). You must also state that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Email your complete counter-notification to our Designated Copyright Agent. We will then forward your counter-notification to the original complainant. If the complainant does not file a court action against you within 10-14 business days, we may restore the content.
